Freelance Design - A$1000.00 for Your Jewellery Design
TERMS AND CONDITIONS OF DESIGNER'S SUBMISSION TO LOVE2HAVE JEWELLERY PTY LTD:
1. Glossary
Business means the manufacturing, distributing, marketing and selling of jewellery products.
Review Period means the period of 30 days from the date we receive your Submission.
Submission means the design, drawing, schematic and all other information submitted by you via our website.
We and us is a reference to Love2Have Jewellery Pty Ltd, its successors or assigns.
You and your is a reference to the author of the Submission, its successors, assigns, officers, agents, employees or consultants.
2. Our acknowledgment
We acknowledge that you have lodged a Submission for us to review during the Review Period and consider its suitability for our Business.
If we, in our absolute discretion, determine that your Submission is suitable for use by our Business, we will, in consideration of you entering into an acceptable contract of assignment, pay you the amount of A$1,000.00 excluding GST.
Payment will be made by [cheque]/[direct transfer into an Australian bank account nominated by you].
3. Confidentiality
We acknowledge that your Submission is your confidential information. We must keep your Submission confidential. We may only use, copy and/or disclose your Submission for the sole purpose of evaluating whether or not to take an assignment of the design contained in your Submission. We agree that we must not use, copy and/or disclose your Submission for any other purpose.
At your request during the Review Period, but before signing any contract of assignment, we must promptly return your Submission to you, together with all copies of any information contained in or derived from your Submission that we have made.
4. No other claims
Except as set out in paragraph 2 above:
(a) under no circumstances will we be liable for any charges, costs, expenses or fees incurred by you in relation to your Submission; and
(b) you will have no claim of any nature whatsoever against us arising out of any matter relating to your Submission.
5. No legal relationship
By lodging your Submission, you acknowledge that:
(a) this is not an offer or an invitation to contract by us;
(b) except as specifically stated, no contract exists or will arise between us and you by virtue of you lodging your Submission unless and until and contract of assignment is executed between you and us; and
(c) we do not have any contractual or other legal obligation to you with respect to the consideration, evaluation, acceptance or rejection of any Submission or the failure to consider, evaluate or accept any Submission.
6. Variations
We reserve our rights, in our absolute discretion and at any stage, to cancel, add to, or amend the information, terms, procedures or evaluation process set out herein, without giving any reasons or notice to you.
